For the purposes of this chapter, the terms below shall have the following meanings:

Accessory apartment” means a residential unit that is located on the same lot or parcel as a single-family dwelling unit, either internal to or attached to the single-family unit or in a detached structure on the same lot or parcel, and which is owned by an owner occupant of the property. The accessory apartment shall be a complete housekeeping unit with a separate entrance, kitchen, sleeping area, and bathroom facilities.

Accessory dwelling unit” means as defined by Utah Code 10-9a-530 or as may be amended.

Internal accessory dwelling unit” means as defined by Utah Code 10-9a-530 or as may be amended.

Owner occupant” means:

a. An individual who:

i. Possesses, as shown by a recorded deed, fifty percent (50%) or more ownership in a dwelling unit, and

ii. Occupies the dwelling unit with a bona fide intent to make it his or her primary residence; or

b. An individual who:

i. Is a trustor of a family trust which:

1. Possesses fee title ownership to a dwelling unit;

2. Was created for estate planning purposes by one (1) or more trustors of the trust; and

ii. Occupies the dwelling unit owned by the trust with a bona fide intent to make it his or her primary residence;

c. An owner occupant as defined in subsection a or b of this definition shall continue to be defined as such even if said owner occupant temporarily resides elsewhere due to a disability, infirmity, military service, temporary job assignments, sabbaticals, or voluntary and ecclesiastical service which requires the owner to temporarily reside at another location not to exceed three (3) years. In such event, the dwelling unit shall be considered an occupied domicile by the owner occupant during the temporary absence.

Owner occupied” means a residential dwelling unit that is occupied by an owner occupant.

Primary dwelling” means as defined by Utah Code 10-9a-530 or as may be amended. (Ord. 2021-10 §1, added, 2021; Ord. 2020-14 § 1, amended, 2020; Ord. 2012-2, amended, 2012)
